Customer Referral Terms

1. About these sample terms

This document is a sample. We publish it so that customers can read how the ConvoHut customer referral program works. It is provided for information only.

The terms that apply are the Customer Referral Terms in force when you make a referral, which you accept by taking part. If those terms are different from this sample, those terms apply.

This sample is not legal advice. Text in square brackets is a placeholder for a figure or choice that has not been confirmed.

In these terms, ConvoHut, we, us and our mean ConvoHut Pty Ltd (ABN 28 702 994 938). You means the ConvoHut customer making a referral. Referred business means the business you refer.

2. Who can refer

You can refer if you are an existing ConvoHut customer with a paid plan [that is current and not overdue].

The referred business must be a new ConvoHut customer. It must not have, or have previously had, a ConvoHut account or subscription.

The referred business must be a different business from yours. You cannot refer yourself, a second account for your own business, or [a business under the same ownership or control as yours].

3. How to refer

To refer a business, send us its name and website using the referral form on our website, with the business's permission, or ask the business to give your business name when it signs up.

We need to be able to match the sign-up to your referral. We cannot always add a referral after the business has started paying, so please tell us before it signs up. [If we introduce referral links or codes, a sign-up through your link or code will also count.]

[A referral is valid if the referred business signs up within 90 days after you tell us about it.]

Only refer people you know or have a real business connection with, and only contact them in ways the law allows. Do not send spam.

4. When the credit is applied

The credit is earned when the referred business pays for its first month or its first year of a ConvoHut plan.

A free trial on its own does not earn the credit. The credit is earned when the first payment is received.

We will apply the credit to your account and to the referred business's account [within 30 days after we receive the first payment, as long as the payment has not been refunded or charged back].

5. What the credit is

Each of you gets one month free. The month free is a credit to your ConvoHut plan. It is not cash, it cannot be paid out or exchanged for cash, and it cannot be transferred to another account.

The credit covers your ConvoHut subscription fee only. It does not cover Meta message charges, which you pay to Meta directly.

[For each of you, the credit equals one month of the subscription fee for the plan you are on when the credit is applied. If you are billed monthly, the credit is applied to your next monthly invoice. If you are billed annually, your current term is extended by one month.]

[A credit that has not been used is cancelled if you close your account. No refund is paid for an unused credit.]

6. Limits and exclusions

There is no limit on the number of businesses you can refer. You earn one month free for each referred business that qualifies. [Credits are applied one after the other, one month at a time.]

Only one credit is earned for each referred business. If more than one customer refers the same business, [the credit goes to the customer who told us about the business first, or the customer the business names when it signs up].

This program cannot be combined with another reward for the same sign-up. [If the referred business was registered by a ConvoHut agency partner or signed up through an affiliate link, no referral credit applies.]

[Agency partners and affiliates are paid under their own programs and do not earn referral credits under these terms for clients or customers they introduce in that role.]

7. Misuse

The program is for genuine referrals. You must not create fake or duplicate accounts, refer yourself, send spam, advertise the program on coupon or deal sites, or make misleading claims about ConvoHut.

If we reasonably believe that a referral is not genuine or breaks these terms, we may refuse or reverse the credit for both accounts and stop you from making further referrals.

If the referred business's first payment is refunded or charged back, we may reverse the credit for both accounts.

8. Changes and general

We may change or end the program at any time. We will [give notice on our website or by email at least 14 days before the change takes effect]. A change does not affect a credit you have already earned.

Your use of ConvoHut continues to be governed by our Terms of Service. These terms only cover referrals.

Nothing in these terms excludes, restricts or modifies any right, remedy or guarantee that cannot be excluded or limited by law, including under the Australian Consumer Law.

These terms are governed by the laws of Victoria, Australia.
